Terms of Use

These terms govern access to the Apelles Editions early-access website, accounts, challenges, and related services.

1. Operator and acceptance

Apelles Editions is an early-stage project currently operated by an individual in Oregon, USA (“Apelles Editions,” “we,” “us,” or “our”). Contact us at ivanmarkchang@gmail.com. By accessing the site or creating an account, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Early-access status

The service is a prototype under active development. Purchases, pledges, auctions, artwork printing, shipping, fulfillment, prizes, payouts, and other commercial features shown or described on the site are not currently operational and are not offers to sell or binding commitments. Features, rules, availability, and content may change or be discontinued at any time.

3. Eligibility and accounts

You must be at least 18 years old and legally able to enter an agreement. You must provide accurate information, safeguard your credentials, and promptly notify us of unauthorized access. You are responsible for activity through your account. We may suspend or terminate accounts reasonably believed to violate these Terms, harm users, manipulate voting, infringe rights, or threaten the service.

4. Challenges and voting

Unless challenge-specific rules state otherwise, each eligible member may cast one vote per challenge. Automated voting, duplicate accounts, coordination intended to distort results, interference, and other manipulation are prohibited. We may investigate, remove votes, disqualify entries, correct errors, or cancel a challenge when needed to protect fairness or comply with law. Displayed vote totals and results may be delayed or corrected. Participation does not guarantee selection, publicity, publication, compensation, or an auction.

5. User and artist content

You remain responsible for content you provide. You may submit only content you have the right to use and license. Artist submissions are also governed by the Artist Submission Terms. We may review, reject, remove, preserve, or disclose content when reasonably necessary to operate the service, enforce these Terms, address infringement, protect safety, or comply with legal obligations.

6. Our materials

The site design, software, branding, text, and other materials supplied by Apelles Editions are owned by us or our licensors. Subject to these Terms, we grant you a limited, personal, revocable, non-transferable right to use the service for its intended purpose. You may not copy, scrape, reverse engineer, disrupt, resell, or misuse the service.

7. Disclaimers

To the fullest extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted operation, security, accuracy, preservation of content, or that planned features will launch. Nothing in these Terms excludes warranties that cannot legally be excluded.

8. Limitation of liability

To the fullest extent permitted by law, Apelles Editions and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, opportunities, or business interruption arising from the service. Our aggregate liability for claims relating to the service will not exceed the greater of $100 or the amount you paid us during the twelve months before the claim. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

9. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Apelles Editions and its operator from third-party claims, losses, and reasonable costs arising from your content, your violation of these Terms, or your infringement of another person’s rights. This provision does not require indemnification for our own unlawful conduct.

10. Copyright complaints

Send copyright complaints to ivanmarkchang@gmail.com with identification of the work, the challenged material and its URL, your contact information, a good-faith statement, an accuracy and authority statement under penalty of perjury, and your signature. This contact method does not represent that a DMCA agent registration has already been completed.

11. Governing law and changes

Oregon law governs these Terms, without regard to conflict-of-law rules, except where mandatory law provides otherwise. Disputes will be brought in a court of competent jurisdiction in Oregon unless applicable law requires another forum. We may update these Terms prospectively. We will post the new effective date and provide additional notice when legally required. Continued use after an update constitutes acceptance where permitted by law.
